====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-02-2021 Perused the show cause dated 03.02.2021 submitted by respondent no.3.

The explanation of non-filing of the counter affidavit on behalf of respondent nos. 2 and 3 is there, hence show cause is accepted.

Counter affidavit and supplementary counter affidavit on behalf of respondent nos. 2 and 3 have already been filed. This writ application was filed for grant of retiral benefits in respect of father of the petitioner who retired as Safai Karmchari (Class-IV) from Nagar Parishad, Madhubani. Respondents have filed their counter affidavit stating the fact that entire retiral dues have already been paid to the petitioner.

Patna High Court CWJC No.14949 of 2017(7) dt.25-02-2021 2/2 Learned counsel for the petitioner disputes the calculation of gratuity amount, however he is not in a position to state as to what was the basic pay of the employee on the date of his retirement.

If the petitioner has still any grievance, he can file representation before the authority concerned who shall pass necessary order within two months from the date of receipt of the representation.

With the aforesaid observation, this writ application stands disposed of.
