The petitioners apprehend their arrest in Banka P.S. Case No. 165 of 2021, registered for the offences punishable under Sections 406, 419, 420 and 120(B) of the Indian Penal Code.

In spite of service of notice, nobody appeared on behalf of Opposite Party No. 2.

It is submitted on behalf of counsel for petitioners that matter has been compromised between the parties and pursuant to the terms of compromise petitioner has already paid Rs. 3,50,000/- out of Rs. 6,00,000/- through bank account on

Patna High Court CR. MISC. No.43607 of 2021(7) dt.10-08-2022 2/2 04.02.2022 Rs. 1,50,000/- and on 18.02.2022 Rs. 1,00,000/- and on 03.03.2022 Rs. 1,00,000/- total Rs. 3,50,000/-before signing of the compromise petition. As per the terms of compromise petition, remaining amount of Rs. 2,00,000/- has been paid after entering into compromise. Rest amount of Rs. 50,000/- will be paid as per the understanding between the parties. In view of the compromise between the parties, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 165 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
