The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 13.08.2021 at about 3:00 am, her minor daughter had gone to attend nature's call but did not return, accordingly a search was made and thereafter the informant came to know that petitioner had enticed her daughter with an intention to marry. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that victim and petitioner were in love and they

No.34660 of 2022(2) dt.28-11-2022 2/2 eloped, it is also submitted that victim has returned and her statement was recorded under Section 164 of the Cr.P.C. wherein she has disclosed her age as 19 years and has not supported the prosecution case rather has stated that she had gone with the petitioner on her own accord and they have even married.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Harnaut P.S. Case No. 358 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
