The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 149, 341, 342, 504, 307, 332, 353 and 427 of the Indian Penal Code and Section 3(1) of the Public Property Act, 1984.

3. As per allegation in the FIR, the petitioner along with several unknown and named FIR persons have blocked the road and tried to assault the policemen and damaged the police vehicle/official vehicle by means of bricks, rod and other materials.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in

Patna High Court CR. MISC. No.37058 of 2024(2) dt.21-05-2024 2/2 this case. He next submits that there is general and omnibus allegation of assault and damage the vehicle. He next submits that similarly situated co-accused has been granted bail by the learned Additional Sessions Judge-III, Barh in ABP No.10342 of 2023 vide order dated 05.12.2023. Petitioner has got clean antecedent and he is in custody since 30.04.2024. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Bakhtiarpur P.S. Case No. 356 of 2017 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Barh, Patna.
