The petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act. Allegation is that one country made pistol along with 19 cartridges and one empty magazine are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.1.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. One country made pistol along with 19 cartridges and one empty magazine are said to have been recovered. No stolen property is alleged to have been

Patna High Court CR. MISC. No.33440 of 2019(3) dt.15-07-2019 2/2 recovered from the possession of the petitioner.There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Juned Alam, J.M. 1st class, Begusarai in connection with Matihani P.S. case No.02 of 2019.
