JUSTICE SUDHIR SINGH ORAL ORDER 14-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 363, 366A/34 and 376(G) of the Indian Penal Code, and Section 7 of POCSO Act.

The prosecution case, in brief, is that the daughter of the informant, namely, Anju Kumari, aged 15 years is a student of 9th standard of Girls' High School, Dalsinghsari. On 20.3.2013, she went for giving examination but she did not return. It is alleged that all accused persons, Navin Kumar Mahto (the petitioner), his father Paltu Mahto, his mother and other persons Binod Kumar Mahto and his wife have kidnapped his daughter with intention to commit her murder.

No.22065 of 2015 (2) dt.14-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.9.2013 and charge sheet has been submitted in the case. It is further submitted that the petitioner may be released after completion of two years in custody i.e., from 22.9.2013.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail after completion of two years in custody i.e., from 22.9.2013 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st, Samastipur, in connection with Dalsingsarai P.S. Case No.82 of 2013 ( G.R. No.164/13). (Sudhir Singh, J) PNM U T
