After considering the submission the prayer for condonation of delay is allowed.
This revision application has been filed against the order by which the learned court below has allowed the prayer for restoration of the suit.
The learned Counsel for the petitioner has submitted that there is doubt over the integrity of the Court as the order was passed on subsequent date after deferring it on the date fixed. The learned Counsel for the petitioner, however, could not show that as to how the impugned order suffers from error or jurisdiction or material irregularity. When query was put by the Court regarding such statement in the revision petition, the learned Counsel has been unable to show such statement.
After considering the submission and perusal of the record,
Patna High Court C.R. No.57 of 2016 (4) dt.22-06-2016 this Court deprecates such statement by the learned Counsel for the petitioner, which in any manner touches the integrity of a Judicial Officer. Such statements are clearly irresponsible when there is no supporting statement in the petition on affidavit. After perusal of the impugned order, this Court does not find that there is any error or jurisdiction or material irregularity. The revision application is, accordingly, dismissed. (V. Nath, J.)
