Both applications are related to Ara Nawada P.S. Case No. 507 of 2014 registered under Sections 341, 324, 386, 307, 506
and 379/34 of the Indian Penal Code and Section 27 of the Arms Act, hence both applications are heard together and are being disposed of by common order.
The allegation of informant, Vikki Kumar, is that he along with his brother, Vikash Kumar was waiting on the road to go to Ara Station, both petitioners came there on motorcycle and demanded Rs.10,000/- as ransom. When the informant made protest then both petitioners started firing in which he sustained injury at his belly in firing of Ran Vijay Kumar and at that time Ravi Kumar took Rs.6000/- from is pocket.
Learned counsel for the petitioners submits that, in fact, Ara Nawada P.S. Case No. 358 of 2014 was instituted by Ranjan Kumar, brother of the petitioner, Ravi Kumar against Mamlesh Kumar, the maternal uncle (Mousha) of the informant due to that reason both petitioners have falsely been implicated in this case who are of same Mohalla. It is further submitted that there is only one injury found at the belly of the informant, which is simple in nature. It is further submitted that petitioners, Ran Vijay Singh and Ravi Kumar are in custody since 11.02.2015 and 06.04.2015 respectively.
Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released
on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Nawada P.S. Case No. 507 of 2014. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
