JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 356/34 of the Indian Penal Code.

Petitioner is neither named in the first information report nor anything was recovered from his conscious possession and it appears from perusal of the impugned order that photograph of the petitioner was shown to the informant and one witness, who claimed to have identified the petitioner and except the aforesaid material as well as criminal antecedent of the petitioner, there is nothing against him.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.12934 of 2016 (2) dt.31-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, (East) Muzaffarpur in connection with Mithanpura P.S. Case No. 11 of 2016.
