The petitioner seeks bail in Jaynagar P.S. Case No. 326 of 2017, instituted for the offence under Section(s) 394, 302, 120(B) of Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that while younger brother of the informant was returning home with a bag containing Rs.3,00,000/-, two miscreants tried to snatch the bag, and on protest, firing was made on him.

Counsel for the petitioner submits that petitioner is not named in the written report. Police arrested the petitioner on suspicion and recorded his confessional statement. There is no recovery of any incriminating article from possession of the

He further submits that other co-accused with similar allegation has already been granted bail by coordinate Benches of this Court vide orders dated 28.9.2018 and 25.4.2019 passed in Cr. Misc. 59433 of 2018 and 6237 of 2019 respectively. Petitioner is in custody since 27.10.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani, in connection with Jaynagar P.S. Case No. 326 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner.
