Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is said to have consumed electric energy illegally by fixing toka and, accordingly, caused damage to the electricity department for more than Rs. five lacs. The petitioner is in jail 29.02.2016 and submission on behalf of the petitioner is that he happens to be bonafide consumer but the officials of electricity department lodged this false case

Patna High Court Cr.Misc. No.12785 of 2016 (2) dt.30-03-2016 2/2 with ulterior motive. Moreover, nothing was seized from the place of occurrence.

Considering the facts aforesaid and submission of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/ - (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (electricity) Magadh area, Gaya in connection with Main P.S. case No.31 of 2015.
