JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. Two gangs of criminals exchanged fire in which one Raman Kumar sustained firearm injury. The statement of aforesaid Raman Kumar was taken by the informant but the aforesaid Raman Kumar did not name the petitioner. No doubt, petitioner is named in the first information report but no specific overt-act has been attributed against him.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.11977 of 2016 (2) dt.17-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Madhubani Nagar P.S. Case No. 334 of 2015.
