2. The petitioner has preferred this application for grant of regular bail in connection with Delha P.S. Case No. 274 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 76, 118, 109, 351(2) and 3(5) of BNSS.
3. As per the prosecution story, the informant has alleged that on 30.10.2024, when she along with her family members was going to temple, meanwhile all the accused persons pulled her hair and also tried to outrage her modesty, when her brother opposed this act, all the accused persons assaulted him.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. From perusal of F.I.R., it clearly transpires that there is no
Patna High Court CR. MISC. No.33522 of 2025(2) dt.26-05-2025 2/3 specific allegation against the petitioner and all the allegations are general and omnibus in nature. The present case lacks motive and there is nothing on the record to show the reason of assault on the informant and her brother by the present petitioner. The investigation is complete and chargesheet has already been filed by the police in this case. The petitioner is man of clean antecedent and he is languishing in custody since 13.01.2025.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
6. Learned counsel appearing on behalf of the informant submits that the photocopy of injury report pertaining to Piyush Kumar (injured) shows total four injuries, only injury no. 2 appears to be grievous because doctor has found fracture in nasal bone. Both the parties belong to same village.
7. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Delha P.S. Case No. 274 of 2024 subject to the following conditions :-

Petitioner will remain physically present in trial on each and every date till the disposal of the case failing which, on two consecutive dates without reasonable cause, the bail bond of the petitioner may be cancelled by the Trial Court.
