JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be owner of Badshah Jewellers and some stolen articles are said to be seized from the house of the petitioner. The co-accused Pappu Singh disclosed before the I.O. that he as well as his associates used to sell stolen and looted articles to the petitioner.

Learned counsel for the petitioner submits that, as a matter of fact, that seized articles have not been produced on T.I.P and petitioner was taken into custody on mere suspicion and detained in custody for several days illegally. Thereafter, the brother of the petitioner filed a petition before the C.J.M,

Patna High Court Cr.Misc. No.11492 of 2016 (2) dt.15-03-2016 2/2 Darbhanga, under section 57 of the Cr.P.C. in which when the learned Chief Judicial Magistrate, Darbhanga, issued show cause notice to the I.O of the present case, then petitioner has been made accused in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U P.S.Case No. 3 of 2016.
