JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-385, 386, 387/34 of the Indian Penal Code and under Sections-3, 4 & 5 of the Explosive Substances Act. Petitioner is not named but in course of investigation, when the mobiles, used in this crime, were put on surveillance, it was detected that that the Sims of the aforesaid mobiles, had been issued in the name of two different ladies and when the inquiry, from the aforesaid two ladies, was made, the aforesaid two ladies disclosed the name of this petitioner, stating that their mobiles had been taken by the petitioner. Moreover, it would appear from perusal of the impugned order that the mobile, which had been

No.12084 of 2016 (2) dt.30-03-2016 2/2 used in the alleged crime, was recovered from the house of one, Saif Ali @ Mahtab and except, the above-said statements of two ladies, there appears to be nothing against the petitioner, who does not have any criminal antecedent and is languishing in jail custody since 11-10-2015.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mehsi P.S. Case No. 137 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate-VIth, Motihari, East Champaran.
