2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 318(4), 303(2), 112, 61(2) of the B.N.S.
3. As per the case of the prosecution when the informant was generating PIN in the ATM, in the meantime, two unknown miscreants entered into the ATM and forcibly took the ATM card from informant and inserted the same into ATM. It is further alleged that on raising alarm by the informant, guard of the ATM along with others came, upon which, the miscreants attempted to flee away. One of the
Patna High Court CR. MISC. No.32730 of 2025(2) dt.22-05-2025 2/3 miscreants was apprehended who was identified as Sanjog Kumar and he named this petitioner as one of the miscreants.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that his name has surfaced in the statement of Sanjog Kumar. Nothing has been recovered from the conscious possession of this petitioner. It has also been submitted that co-accused Sanjog Kumar has already been granted bail by a learned co-ordinate Bench of this Court vide order dated 19.04.2025 in Cr. Misc. No. 5143 of 2025. The case of this petitioner stands of better footing. Moreover, he is languishing in judicial custody since 30.12.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chiraiya P.S. Case No. 471 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First
