Petitioner seeks bail in Baisi P.S.Case No.19 of 2014 registered under Sections 302/34 IPC but charge sheet submitted under section 304B/34 IPC.

The petitioner is alleged to have assaulted and killed his wife. It is submitted that there is no eye witness of the occurrence but from perusal of the records, it appears that the petitioner was torturing his wife. The Post Mortem Report shows that the victim had injuries on her abdomen and neck and the cause of death is asphyxia due to strangulation. Having considered the fact aforesaid, I am not inclined to enlarge he petitioner on bail and accordingly, the same is rejected. The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt or production of a copy of this order.
