The petitioner is accused in connection with Kesariya P.S. Case No. 117 of 2015, registered under Section 413, 414/34 of the Indian Penal Code.
The prosecution case is that the informant being the Officer-in-Charge, Keshariya P.S. received informant about apprehending of the accused by the public, who committed theft of the motorcycle at Line Hotel. Thereafter, this petitioner was apprehended by the Police, who disclosed about keeping the theft motorcycle at the house of Bigu Mahto and also at the house of Suraj Singh.
Learned counsel for the petitioner submits that it
Patna High Court Cr.Misc. No.13768 of 2016 (2) dt.26-04-2016 2/2 would appear from the F.I.R. that petitioner was apprehended by the public and due to some dispute arose in the line hotel he has been handed over to the Police and Police got recorded the confessional statement of the petitioner showing the involvement of the petitioner in the theft and recovery of the motorcycle. The petitioner having no criminal antecedent is in custody since 20.05.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari East Champaran in connection with Kesariya P.S. Case No. 117 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
