The petitioner seeks bail in Navinagar P. S. Case No. 02 of 2019 instituted for the offence under Section(s) 363, 365 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no any specific allegation of overt act against this petitioner in the written report.

In the written report it is alleged that brother of the informant had gone with this petitioner for job to Vijaywada, Andhra Pradesh on 7.7.2018 . It is further alleged that brother of informant remained in contact with family members of informant for a month and when the brother of the informant, namely, Sanjay Thakur did not return, the informant enquired

It is also alleged that when informant made call on the mobile of his brother, he found his mobile phone switched off. Learned counsel for petitioner submits that brother of the informant himself has filed a petition before the police stating that his brother had gone missing while traveling in train. The application dated 23.10.2018 sent to the SP by brother of the informant is annexed as Annexure-2 to the bail petition. Petitioner is in custody since 13.3.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. 1st Aurangabad, in connection with Navinagar P. S. Case No. 02 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
