The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Yadopur P.S. Case no. 142 of 2023 instituted for the offence under Sections 341, 323, 324, 379, 504, 506, 307/34 of the Indian Penal Code.

As per allegation in the FIR, the informant was taking meal at his house in the meantime, accused persons armed with lathi, farsa came there and started to abuse the informant. On protest, the co-accused Rakesh Pandit assaulted him by means of iron rod.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no

Patna High Court CR. MISC. No.37430 of 2024(2) dt.17-05-2024 2/2 offence. He has got no criminal antecedent as stated in para-3 of the bail petition. There is no specific overt-act against the petitioner rather the same was attributed to co-accused Rakesh Pandit. It is further submitted that the FIR has been lodged after three days of the occurrence. Moreover, co-accused Prabhu Singh had been granted bail by this Court vide order dated 5.9.2023 passed in Cr. Misc. No. 56167 of 2023. Learned APP appearing for the state has opposed the prayer of bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Yadopur P.S. Case no. 142 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Gopalganj subject to the conditions as laid down under section 438(2) of the Cr.P.C.
