The petitioners seek bail in Hajipur Town P.S. case no. 397 of 2018 instituted for the offence under Section(s) 363 and 366A/34 of the IPC.
Earlier, the prayer for bail of petitioners was rejected by this Court vide order dated 8.10.2018 passed in Cr. Misc. no. 55553 of 2018.
There is direct allegation against these petitioners of kidnapping daughter of informant. The daughter of informant is still traceless.
The report called for from the Court has been received
Patna High Court CR. MISC. No.32853 of 2019(3) dt.17-07-2019 2/2 and placed at Flag- 'P', wherein, it is mentioned that charge has already been framed and the case is pending for evidence. The Trial Court has further mentioned in the report that trial is likely to be concluded within six months.
Therefore, this Court is not inclined to grant bail to petitioners. Accordingly, prayer for bail of petitioners stand rejected, at this stage.
Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of six months from the date of receipt of copy of this order.
Petitioners may renew their prayer for bail in the event trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U T
