JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offence punishable under Sections 30(a)/38 of Bihar Excise and Prohibition Act, 2016.

30 liters Nepali liquor are said to have been recovered from a field. Allegedly, petitioners were caught while they were fleeing from there after throwing the recovered liquor. Petitioners do not have any criminal antecedent as it is evident from perusal of para 3 of the petition.

Submission on behalf of the petitioners is that

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners are languishing in jail custody since 08.04.2019, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Araria in connection with Special Case No. 527 of 2019 arising out of Sikti P. S. Case No. 52 of 2019.
