2. Petitioner seeks regular bail in connection with Excise P.S. Case No. 409 of 2024 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 12.570 litres foreign liquor was recovered from the spot.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 25.03.2025.

5. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.32851 of 2025(2) dt.18-07-2025 2/2 bail application of the petitioner and submits that petitioner has got three criminal antecedents of similar nature.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge, Sheikhpura in connection with Excise P.S. Case No. 409 of 2024.
