Direction of this Court under order dated 24.4.2018 in the writ proceedings was based on the recommendation dated 4.6.2014 for regularization of the petitioners. This Court had directed to complete the formality pursuant to the said recommendation.
Show cause and supplementary show cause have been filed. It is the specific stand of the opposite parties that the Chief Engineer has found that then then Executive Engineer has recommended and sent the recommendation without considering all aspect of the matter and the list, therefore, was found to be unsustainable. The same has been issued by the incompetent
Patna High Court MJC No.3356 of 2018(4) dt.28-11-2018 2/2 authority i.e. Executive Engineer without approval of the Chief Engineer and without roster clearance. It is also been found that much prior to the recommendation the petitioners had been retrenched in the year 1989, whereafter they never worked. In view of such submission in the show cause this Court would find that the consideration of the petitioners' claim pursuant to the recommendation dated 4.6.2014 has been completed.
