The petitioners have preferred this application for grant of regular bail in a case registered under sections 30(a), 37(b) and 37(c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, seeing the police personnel, the accused persons including the two petitioners herein made an attempt to escape but were caught. A total of 130 litres of liquor was recovered from a can abandoned by them.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from possession of the petitioners. They have been falsely implicated
Patna High Court CR. MISC. No.44725 of 2021(4) dt.09-03-2022 2/2 in the case. They are ladies and are in custody since 3.3.2021. They have no criminal antecedent and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioners not having any criminal antecedent, the petitioners are directed to be enlarged on bail in connection with Digha P.S. Case no. 138 of 2021 (Spl. Case no. 1538 of 2021) on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
