JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The deceased was working as domestic helper in the house of petitioner and the dead body of the deceased was found in the house of petitioner. The post-mortem report reveals that the death of deceased was not an accidental death. Learned counsel appearing for the petitioner tried to convince me about the innocence of the petitioner placing his submission that the dead body of deceased was found on the roof of house of the petitioner and three families were residing in the said house at the time of alleged occurrence. It is also pointed out on behalf of the petitioner that just after recovery of dead body of the deceased, the petitioner sent information to

Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail at least at this stage and, accordingly, the prayer for bail of the petitioner in connection with Katihar Town P.S. Case No. 694 of 2014, pending in the court of the learned Chief Judicial Magistrate, Katihar stands rejected.

However, the learned Chief Judicial Magistrate, Katihar is directed to commit the case of the petitioner to the court of sessions in accordance with law within two weeks from the date of receipt/production of a copy of this order and after that the concerned sessions court should expedite the trial of the petitioner and try to conclude the same as early as possible.
