JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 07-02-2017 The grievance of the petitioner is that "Deswari" sub caste of Kharwar caste as described in the Constitution (Scheduled Tribes) Order, 1950 should be added at serial no.17. We do not find that any amendment by including subcaste of a Kharwar can be directed by this Court as such inclusion depends upon the numerous factors as delineated in Indra Sawhney v. Union of India, 1992 Supp (3) SCC 217. Therefore, this Court will not intervene in the matter which falls within the exclusive domain of
Patna High Court CWJC No.6028 of 2016 dt.07-02-2017 2/2 the expert body.
Consequently, the present writ application is dismissed with liberty to the petitioner to make representation to the appropriate authority in accordance with law.
