JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 302 and 120B of the Indian Penal Code. Petitioner happens to be wife of the deceased and admittedly, the deceased and petitioner had taken divorce by mutual consent. The information regarding death of the deceased was given to informant by the family members of the petitioner. No doubt, the dead body of the deceased was found in the parents house of the petitioner but learned counsel for the petitioner drew my attention towards the order dated 23.2.2016 passed in Cr. Misc. No.54897 of 2015 and analogous case and submitted that

Patna High Court Cr.Misc. No.13099 of 2016 (2) dt.31-03-2016 2/2 while considering the aforesaid Cr. Misc. cases, a Co-ordinate Bench of this Court got opportunity to peruse the case diary of the present case and it was noticed by the Co-ordinate Bench of this Court that the son of deceased specifically stated before the I.O. that deceased had committed suicide.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Rohtas at Sasaram in connection with Sasaram (Town) P.S. Case No.840 of 2015.
