The petitioner has been arrested in connection with Bheldi P.S. Case No. 134 of 2015 registered under Sections 25(1-b)a, 26(a) and 35 of the Arms Act.

It is alleged that while the police party in patrolling duty apprehended the accused persons on motorcycle, but they did not produce any paper. However, from the possession of the petitioner one live cartridge was recovered.

Learned counsel for the petitioner submits that except this case, seven cases against this petitioner out of which one case is Arms Act. It is further submitted that petitioner is in jail custody since 20.08.2015.

Having regard to the facts and circumstances of the case,

Patna High Court Cr.Misc. No.13433 of 2016 (2) dt.22-04-2016 the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Bheldi P.S. Case No. 134 of 2015, subject to condition that one of the bailors shall be near relative of the petitioner who will file an affidavit to this effect that petitioner shall not indulge in such activity in future.
