The petitioner seeks bail in Forbesganj P.S. Case No. 610 of 2014, registered for the offences punishable under Sections 366A, 370A, 372, 373 and 376 of the Indian Penal Code, Sections 3, 4, 5, 6 of the Immoral Traffic Act and Section 4 of the POSCO Act.

The informant made allegation against Gainul that he sold her and her sisters for prostitution.

Learned counsel for the petitioner submits that the informant did not make any allegation against the petitioner. But during the course of investigation Manisha and Khushbu Khatoon are said to have been recovered from the house of the petitioner Raju Singh and their statement were recorded in para-19 and 20 of

Patna High Court Cr.Misc. No.4197 of 2015 (4) dt.22-04-2015 2/2 the case diary.

It appears that Manisha did not state about any illtreatment at the hands of the petitioner and she disclosed that she is maid servant in the house of the petitioner. Khushbu Khatoon has stated that she is a maid servant and working in the house of the petitioner, but she was forced to have sexual relations and the petitioner use to collect money. For the reasons best known to the investigating officer, the statement of both the victim could not be recorded under Section 164 of the Cr.P.C. The petitioner is in jail since 28.08.2014.

Considering the facts aforesaid and the nature of allegations made against the petitioner and the fact that the petitioner has got no criminal antecedent, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.
