The petitioner apprehends his arrest in connection with Bihiya P.S. Case No. 175 of 2018, registered under Section 341, 323, 379 and 307/34 of the Indian Penal Code. The accusation is that petitioner caught hold the informant, Binod Kumar Singh and Brij Kumar Singh started to assault through iron rod causing injury at the head of the informant.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that the allegation of causing assault to the informant through iron rod is against Brij Kumar Singh and at that time, this petitioner is only caught hold the
Patna High Court CR. MISC. No.33386 of 2019(2) dt.21-05-2019 2/2 informant. Moreover, the injury, as found on the person of the informant, is simple in nature and petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Arrah, in connection with Bihiya P.S. Case No. 175 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
