JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Banmankhi P.S. Case No. 178 of 2015 registered under Section 365/34 of the Indian Penal Code.

The accusation is of kidnapping of Rajeev Kumar Yadav, brother of informant, taking him from vehicle by the five accused persons including the petitioner.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that victim, Raj Kumar Yadav, brother of the informant, was said to be kidnapped by the petitioner and other

No.13639 of 2016 (2) dt.12-04-2016 accused persons named in the F.I.R. at about 12 'O' clock in the noon but the victim was recovered by the police on 01.09.2015 near the canal, which would appear from paragraph 33 of the case diary. Further submission is that the statement of the victim was recorded under Section 164 Cr.P.C., in which, he has stated about kidnapping by the petitioner and other accused persons named in the F.I.R. and keeping him in Namni village due to land dispute but he has not detailed about demanding of ransom and giving threatening in any manner. It is further submitted that petitioner and others have falsely been implicated in this case due to land dispute and petitioner is in custody since 28.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Purnea, in connection with Banmankhi P.S. Case No. 278 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
