Mr. Ravindra Kumar, Assisting counsel to AAG-6, appears and invites attention of the Court towards the prayer made, which seeks a direction to the Authorities in the Mines Department, insofar as the District of Nawada is concerned. According to the petitioner, unscrupulous elements have indulged in the illegal mining of sand at the bank of Sakari River in the District of Nawada.

Learned counsel appearing on behalf of Respondent

Patna High Court CWJC No.681 of 2018(2) dt.15-01-2019 2/2 no. 5 submits that the Superintendent of Police, Nawada has denied any such instance of illegal mining.

In such view of the matter, the writ petition is disposed of with liberty to the petitioner in case he is sanguine on his cause, to approach the Principal Secretary, Mines Department with supportive documents and it goes without saying that in case the petitioner files any such representation with supportive documents indicating instance of illegal mining at the Bank of Sakari River, in the district of Nawada, the Principal Secretary, Mines Department, Government of Bihar shall consider and dispose of the same in accordance with law and in case the issue raised is found to be true, then he shall proceed to take appropriate action in this regard. With the observation, as above, the writ application is disposed of.
