Petitioner seeks bail in Alamganj P.S.Case No.235 of 2014 registered under Sections 394 IPC.

The informant alleged that when he was going to village on an auto-rickshaw, the petitioner and others pulled him near Hajipur and snatched the money and mobile.

It is submitted that though the petitioner is not named in the FIR but from perusal of the case diary, it appears that one mobile was recovered from the house of the petitioner but the petitioner was not present there. The petitioner was in the jail. From perusal of para- 95 of the case dairy, it appears that the petitioner confessed his guilt and disclosed the fact that he looted the mobile and in pursuance thereof, the looted mobile was recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail and accordingly, the same is rejected. (Prabhat Kumar Jha, J) ahk/- U T
