Petitioner seeks bail in a case registered under sections 395 and 412 of the Indian Penal Code.

The name of the petitioner came in this case in the confessional statement of co-accused Md Muslim who has already been granted privilege of bail by a coordinate bench of this court vide order dated 21.04.2009 passed in Cr. Misc. no.4822/2009. No doubt, alleged occurrence took place in the year 2008 and the petitioner could be remanded in this case in the year 2016 but taking into consideration the above stated facts and circumstances as well as this aspect of the matter that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri A.B.D. Dubey, Judicial Magistrate, Araria in Araria (Bairgachhi) P.S. Case no. 592/2008.
