For the reasons disclosed in the present MJC application, supported by a supplementary affidavit, the prayer for restoration of F.A.No. 335 of 1990, which stood dismissed on account of partial compliance of the order dated 13.02.2014 is allowed, subject to the condition that aforesaid order dated 13.02.2014 passed in aforesaid F.A.No. 335 of 1990 must be fully complied within a period of one week from today, failing which it shall be construed that the present MJC application stood dismissed on account of non-compliance of the court's peremptory order.
If the present order is complied with within the time prescribed, F.A.No. 335 of 1990 shall be restored to its original
Patna High Court MJC No.1065 of 2016 (2) dt.19-10-2016 2/2 file and thereafter it shall be listed before an appropriate Bench, as per roster, and shall no longer be treated as a part heard or tied up matter to this Bench.
