The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

The prosecution case, in short, is that two unknown persons having pistols in their hand came near the door of the office of the informant and took out key of the cash room and tied the informant and other employees of the office. It is also alleged that the accused persons looted the cash kept in the bag. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-02-2019. Charge sheet in this case has already been submitted. The petitioner has been falsely implicated in the present case. The

Patna High Court CR. MISC. No.31913 of 2019(2) dt.14-05-2019 2/2 name of the petitioner surfaced in this case on the basis of selfconfession of the petitioner. There is no recovery of any incriminating article from possession of the petitioner. He has not been put on test identification parade. It has further been submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Gaya in connection with Guraru P.S. Case No. 12 of 2019.
