JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2019 This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No. 456 of 2018, disclosing offence under Section 366A of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that the F.I.R. itself shows that there is love affair between petitioner and victim girl and now it appears that they are residing in Delhi and due to fear, the petitioner could not appear before the court below or could not get the victim appear in the court.

Heard learned A.P.P. and learned counsel for the opposite party no.2 also, they have opposed the prayer for anticipatory bail of the petitioner.

No.32342 of 2019(3) dt.31-07-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if the victim girl appear and her statement recorded under Section 164 of Cr.P.C., the learned court below shall consider the same, while considering the prayer for regular bail of the petitioner.
