ANJANA MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420, 406, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is an allegation that the petitioner was one of the directors of the Company and had started the Company which eventually disappeared with the money of the investors, the petitioner was merely an agent of the said Company, who like the informant himself had been collecting money from the investors and depositing the same in the Company. Subsequently, the Director disappeared leaving the petitioner as an Agent in the lurch

Patna High Court Cr.Misc. No.12317 of 2016 (3) dt.20-05-2016 alongwith the investors. He further submits that he has himself been taken unaware on account of the conduct of the petitioner and he is similarly situated as the informant himself who is making the allegation in the complaint petition. Considering the aforementioned facts and circumstances and that the petitioner does not have any criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 368 of 2010 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
