JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail on behalf of the petitioners all of whom belong to the same family, who are accused in a case registered for the offences punishable under Sections 147, 341, 342, 323, 324, 307, 379, 326 and 504 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners has submitted that the present Bishanpur P.S. Case No. 22 of 2015 came to be instituted because of the dispute between the two

Patna High Court Cr.Misc. No.19564 of 2015 (3) dt.09-07-2015 2/2 families. In the altercation, between the parties petitioner no. 1 also received injuries. Case and counter case on both sides were filed. The petitioners have no criminal antecedent. He submits that no purpose would be served if the petitioners are taken into custody, who will co-operate with the Police in course of investigation.

In view of the submission as above, let the petitioners above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Bishanpur P.S. Case No. 22 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
