The petitioner seeks bail in a case instituted for the offences under Sections 7 of the Essential Commodities Act. It has been alleged that 260 bags of rice with the label of Bihar State Good and Civil Supplies Corporation was seized from the truck bearing registration no. WB15A-2463. Learned counsel for the petitioner submits that petitioner has nothing to do with the aforesaid rice which has been seized and so much so one Manish Sah has filed a case before this Court vide C.W.J.C. No.2029 of 2015 for release of the truck and this Court has disposed of the matter with a direction to the District Magistrate to dispose of the matter in

Patna High Court Cr.Misc. No.19284 of 2015 (2) dt.16-06-2015 terms of the order passed by Hon'ble Supreme Court in the case of Sunderbhai Ambalal Desai V. State of Gujarat, reported in (2002)10 SCC 283.

Having considered the facts and circumstances of the case, let petitioner, Sudhir Sah, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Hajipur in Desari P.S. Case No.306 of 2014, subject to the conditions that one of the bailors shall be a close relative of the petitioner. (Shivaji Pandey, J) Vinay/- U T
