The petitioner seeks pre-arrest bail in connection with Chapra town P.S. Case No. 382 of 2015 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 506 of the Indian Penal Code.
It has been contended that the present case has been instituted in retaliation to Chapra town P.S. Case No. 385 of 2015 dated 12.11.2015 registered under Sections 147, 148, 149, 341, 323, 324, 307 and 506 of the Indian Penal Code which was lodged by one of the accused of this case, namely, Sunil Singh,
Patna High Court Cr.Misc. No.13758 of 2016 (2) dt.31-03-2016 2 / 2 who had received serious injuries because of which he was sent for treatment to hospital where his fardbeyan was recorded. It is further contended that the members of the prosecution party were aggressor and they had brutally assaulted the accused persons of the present case. It is also contended that the injuries sustained by the members of the prosecution party are either simple or on non-vital part of the body.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner, who is reported to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra town P.S. Case No. 382 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
