02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Nagar P.S. Case No. 476 of 2020, registered for the offence under Sections 414, 420, 467, 468 of the Indian Penal Code.

As per the prosecution case, this petitioner was apprehended with a stolen motorcycle and a mobile with SIM card.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. As per F.I.R. itself, the petitioner was allegedly arrested in Town P.S. Case No. 463 of 2020 on 15.12.2020 and present F.I.R. has been lodged on 24.12.2020 and this itself goes to show that present case is out-and-out a false case. Petitioner is in custody since 29.01.2021. Chargesheet has been submitted.

Patna High Court CR. MISC. No.43717 of 2021(2) dt.02-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Nagar P.S.
