The petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 472 of 2022 for the offence registered under Section 304 B of the Indian Penal Code. As per the prosecution case, petitioner being motherin-law of victim alongwith other co-accused persons killed the informant's daughter due to non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence as alleged. The victim had died due to health issues and the husband of the deceased has already surrendered before the learned court below. Charge-sheet has already been submitted in
Patna High Court CR. MISC. No.35402 of 2023(2) dt.07-07-2023 2/2 this case and there is no chance of absconding of the petitioner or tampering with the evidence. Petitioner has no criminal antecedent. Petitioner is a lady and she is in jail custody since 03.04.2023.
Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 472 of 2022.
