JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Supplementary affidavit and counter affidavit are filed but learned counsel appearing for the petitioner submits that due to inadvertence some important facts were left to be typed in bail petition.
It is submitted on behalf of the petitioner that as a matter of fact, there was serious litigation between the petitioner and informant and several cases were lodged by the informant of the present case against the petitioner but the aforesaid cases were left to be mentioned at para-3 of the petition and when this petition was taken up for hearing, the aforesaid fact was brought to the notice of this court by filing counter affidavit. However, petitioner wants to file a fresh petition after ascertaining the details of each and every cases lodged against him and that is the reason he wants to withdraw this petition.
Patna High Court Cr.Misc. No.14794 of 2016 (3) dt.19-04-2016 2/2 In view of the aforesaid submissions, this petition filed in connection with Bahera P.S. Case No. 326 of 2014 stands dismissed as withdrawn.
However, petitioner may file a fresh petition in accordance with the rules.
