2. The petitioner in this application prays for grant of regular bail in connection with Tilauthu P.S. Case no. 107 of 2025 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on a search being conducted 120 litres of liquor was recovered from the motorcycle in question and the petitioner was taken into custody.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No incriminating article recovered from his possession or from his motorcycle. He is in custody since 19.4.2025 and has no criminal antecedent. He undertakes to cooperate in the trial.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., specially the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, the Court directs the petitioner to be enlarged on bail in connection with Tilauthu P.S. Case no. 107 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise Court no.02, Rohtas at Sasaram.

7. In case it is discovered that the petitioner has criminal antecedent, the prosecution will be at liberty to move this Court for cancellation of bail of the petitioner. (Partha Sarthy, J) Bibhash/- U T
