The petitioner is accused in connection with G.R.P. Patna (Rajendra Nagar) P.S. Case No. 54 of 2015, registered under Sections 302, 201 and 379/34 of the Indian Penal Code. The prosecution case is that Raju Kumar, son of the informant moved in the evening of 13.02.2015 on motorcycle, but he did not return in the night. On the next day his dead body was found at railway track near V.N. Hospital in front of Jay Mahavir Colony, Bahadurpur. It is further alleged that on 08.02.2015 in the evening, the petitioner and three others had given threatening to kill his son for not giving money for taking liquor. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that
Patna High Court Cr.Misc. No.13709 of 2016 (2) dt.21-04-2016 2/2 informant is not eye-witness of the occurrence. The name of the petitioner has been figured merely on suspicion due to previous dispute. Further submission is that petitioner having no criminal antecedent is in custody since 31.12.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Patna in connection with G.R.P. Patna (Rajendra Nagar) P.S. Case no. 54 of 2015.
