JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 3A RP (UP) Act, 1966. Petitioner was caught on the spot where he and two others assembled to commit theft of battery of railway but admittedly, one mobile is said to have been recovered from conscious possession of the petitioner. Moreover, petitioner is in jail custody since 11.03.2019 and he does not have any criminal antecedent.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the
