The petitioner seeks bail in Hisua P.S. Case No. 99 of 2014, registered for the offences punishable under Sections 366A, 376D and 34 of the Indian Penal Code and Section 6 of the POSCO Act.

The victim made allegation that when Puja Kumari called her she came out from her house. Upendra Kushwaha and Dayadarshi Kumar took her inside the rice mill where Baliram Singh the petitioner was keeping guard. Upendra Kushwaha and Dayadarshi Kumar @ Rajeev and Priyadarshi Kumar @ Chhote committed rape with her.

Learned counsel for the petitioner submits that Priyadarshi Kumar @ Chhote and Dayadarshi Kumar @ Rajeev

Patna High Court Cr.Misc. No.5805 of 2015 (4) dt.23-04-2015 2/2 have already been enlarged on bail by the learned Additional Sessions Judge, Nawada. The case of the petitioner stands on better footing as he did not even touch the body of the victim and it is alleged that the petitioner was keeping watch. The petitioner happens to be watchman of the rice mill. The petitioner is in jail since 06.05.2014 and has remained in jail for about one year. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Nawada in connection with Hisua P.S. Case No. 99 of 2014.
