The petitioner apprehends his arrest in Purnahiya P.S. Case No. 27 of 2013, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code. The wife of the deceased made allegation that the petitioner and others assaulted her husband with iron rod, Khanti and other arms and her husband died.

It is submitted that the date of occurrence is of 12.03.2013 but the fardbeyan was recorded on 26.03.2013.Sanju Devi and Kanti Devi have already been granted anticipatory bail by this Court.

It appears that there is specific allegation against the

Patna High Court Cr.Misc. No.19723 of 2015 (3) dt.02-07-2015 petitioner that he assaulted the deceased with butt of pistol on his head. The case of Kanti Devi and Sanju Devi are quite different, as they were ladies.

Having considered the facts that the petitioner assaulted the deceased with the butt of the pistol, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
